The Act on the Further Development of Skilled Worker Immigration Has Now Been Passed by the Bundestag

In the future, it should be easier for foreign skilled workers to enter Germany.

On June 23, 2023, the Bundestag passed the Act on the Further Development of Skilled Worker Immigration. Most of the new regulations are expected to take effect in the first few months of 2024.

The changes are intended to make it easier for foreign skilled workers to come to Germany and to address the ongoing shortage of skilled workers. Three key areas have been identified: the skilled worker pillar, the experience pillar, and the potential pillar.

For example, the changes expand the possibilities of the EU Blue Card by lowering existing salary thresholds for standard and shortage occupations. Additionally, changing employers is to be made easier if the card has already been issued, as is family reunification.

Proof of professional recognition of the qualification in Germany prior to the interested skilled worker’s entry is no longer required if the person can demonstrate at least two years of professional experience as well as a vocational qualification obtained abroad and recognized by the state there. In addition, a salary threshold must be met. Foreign skilled workers can enter Germany under these conditions and begin the recognition process only after arriving in Germany.

An Opportunity Card is to be introduced for all those who have not yet received a concrete job offer but demonstrate significant potential. The assessment is conducted using a points-based system. Language skills, professional experience, and other criteria play a role in this process.
